Reproductive Rights


Community Legal Centres NSW opposes legislation to give legal personhood status to a foetus.

Fred Nile has circulated to his colleagues a draft bill (Crimes Amendment (Zoe's Law) Bill 2015) to give legal personhood status to a foetus. We have only just received a copy of the draft bill and will be able to provide more analysis later.

If this proceeds it would be the first piece of legislation in NSW to draws a distinction in personhood between a woman and the foetus she is carrying. This would pave the way for broader changes granting legal rights to foetuses, which have resulted in prosecutions of mothers elsewhere where they are deemed to have acted contrary to the interests of the “person” they are carrying.

This legislation raises serious concerns for women’s reproductive rights.

Giving legal status with associated rights to a foetus whilst inside a woman with her own legal status and associated rights is unwise.
